ThinkAI Academy LLC classes may include, not limited to, the use of computers, tablets, web-based tools, creative software, and AI-assisted applications for educational purposes.
I understand and agree that:
1. My child may use instructor-approved digital tools and AI tools during class.
2. AI-generated content may be inaccurate, incomplete, biased, or otherwise imperfect.
3. ThinkAI Academy LLC will supervise classroom use, but cannot guarantee that every output generated by a third-party tool will always be appropriate or error-free.
4. My child will be instructed not to enter highly sensitive personal information into class tools.
5. ThinkAI Academy LLC may use third-party software providers to deliver educational activities.
6. Student work created during class may be stored, displayed internally, or shared with me for educational purposes.
I consent to my child’s use of approved technology and AI tools as part of classroom instruction.
6. Data Privacy & COPPA Compliance
How we collect, use, and protect your child’s information
ThinkAI Academy LLC takes the privacy of children seriously and comply fully with the Children’s Online Privacy Protection Act (COPPA).
ThinkAI Academy LLC may collect and use the following information for enrollment, safety, class operations, and communication:

parent/guardian contact information,

child name, grade, and age range,

emergency and medical information,
-
attendance and class participation records,
-
student project files or work product
ThinkAI Academy LLC uses this information to:

provide classes and communicate with families,

maintain safety and emergency preparedness,

support student participation in educational activities,

improve program operations,
-
comply with legal obligations.
ThinkAI Academy LLC may share information with service providers only as reasonably necessary to operate the program, such as registration systems, communication tools, payment processors, or educational technology platforms.
Parents may request to review, correct, or delete child information held by ThinkAI Academy LLC, subject to legal and operational requirements.
Digital Storage
All student work is stored in an individual cloud folder accessible by the student and parent/guardian for 2 months from the program end date. After 2 months, files are securely deleted unless the family requests an extension in writing.
Third-Party Tool Data
ThinkAI Academy LLC uses class-level accounts for all third-party tools. Student personal information is not shared with third-party platforms. We encourage parents to review individual privacy policies:

7. Device & Internet Use Policy
All device use is supervised by certified educators
All device and internet use during ThinkAI Academy LLC sessions is supervised by certified educators. The following rules apply:

Students use only the tools and websites directed by their teacher

Personal social media, gaming, or non-curriculum websites are not permitted during sessions

Students are expected to treat all digital tools and devices with care and respect

Students will be instructed not to enter highly sensitive personal information into class tools.

Any inappropriate use will result in a parent notification and possible loss of device privileges

ThinkAI Academy LLC uses content-filtered networks and age-appropriate platform settings

ThinkAI Academy LLC will supervise classroom use, but cannot guarantee that every output generated by a third-party tool will always be appropriate or error-free.
8. Program Code of Conduct & Dismissal Policy
A safe, respectful, and inclusive learning environment for all
ThinkAI Academy LLC is committed to providing a safe, respectful, and inclusive learning environment for all students. We ask all enrolled families to agree to the following:

Students will treat peers, teachers, and all materials with respect

Bullying, exclusion, or unkind behavior of any kind is not tolerated

Students will follow instructor directions during all sessions

Parents/guardians are expected to ensure timely drop-off and pick-up
Dismissal Policy
ThinkAI Academy LLC reserves the right, at its sole discretion, to refuse, suspend, or dismiss any student from the program if their participation negatively affects the wellbeing or safety of other students or staff. In the event of dismissal, standard cancellation policies apply. Examples of behaviors that may result in immediate dismissal include, but are not limited to:

Hitting, shoving, pushing, biting, kicking, or physical aggression toward students or staff

Threatening physical aggression toward any person

Making derogatory or discriminatory remarks related to race, gender, religion, sexual orientation, or any other protected characteristic

Repeated and targeted verbal aggression or harassment toward students or staff
-
Bringing prohibited items, weapons, or substances to sessions
-
Deliberate misuse of technology, devices, or AI tools in a harmful or inappropriate manner
-
Being unable to follow staff instructions such that safety concerns arise
9. Assumption of Risk & Release of Liability

Assumption of Risk
I understand and acknowledge that participation in ThinkAI Academy LLC programs involves certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. These risks include, but are not limited to: in-person interaction with other children and adults; use of computers, tablets, and related equipment; minor physical activity during group exercises and camp activities; and the potential negligence of others.
I understand and appreciate these risks, and I acknowledge that my child’s participation is voluntary. I knowingly and freely assume all such risks on behalf of my child, both known and unknown.
Release of Liability
To the fullest extent permitted by applicable law, I hereby release, waive, discharge, and hold harmless ThinkAI Academy LLC, its owners, officers, directors, employees, contractors, volunteers, and agents (collectively “ThinkAI Representatives”) from any and all claims, demands, liabilities, damages, losses, costs, and expenses of any kind - whether known or unknown, foreseen or unforeseen - arising out of or in any way related to my child’s participation in ThinkAI Academy LLC programs, including but not limited to personal injury, accident, illness, or property loss.
Indemnification
I agree to indemnify and hold harmless all ThinkAI Representatives from and against any claims, suits, proceedings, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of: (a) my child’s participation in any ThinkAI Academy LLC program or activity; (b) any breach of these terms by me or my child; or (c) any personal injury, accident, illness, or property damage arising from such participation.
10. Dispute Resolution & Governing Law
California law governs - class action waiver applies
Governing Law
These terms and any disputes arising from them shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict-of-law provisions. Any disputes shall be litigated exclusively in the state or federal courts located in Santa Clara County, California.
Informal Resolution First
Before initiating any legal proceeding, I agree to first provide ThinkAI Academy LLC with at least thirty (30) days’ advance written notice describing the nature of the dispute and to work in good faith toward a mutually agreeable resolution.
Class Action Waiver
To the maximum extent permitted by applicable law, I agree that any dispute, claim, or cause of action arising out of or connected with ThinkAI Academy LLC’s programs or these terms will be resolved on an individual basis only. I waive any right to participate in any class action, collective action, or representative proceeding against ThinkAI Academy LLC.
Time Limitation
I agree to bring any claim or dispute against ThinkAI Academy LLC within 2 months from the date the cause of action accrued. Any claim brought after this period shall be deemed time-barred.

12. Payment Terms & Fees
Program fees, payment methods, cancellation & refund policy
Program Fees

Program fees are published at thethinkaiacademy.com and are subject to change for future enrollment periods.

Fees are quoted per student, per session/week, and include all instructional materials and supervised technology access.

A non-refundable enrollment deposit is due at the time of registration and will be applied toward the total program fee.

The remaining balance is due no later than the date specified in your enrollment confirmation, unless otherwise agreed in writing.
Accepted Payment Methods

Online payment via credit card, debit card, or ACH bank transfer through our secure registration portal.
-
ThinkAI Academy LLC does not store credit card information on its own servers; payment processing is handled by a PCI-compliant third-party processor.
Cancellation & Refund Policy
-
Due to the limited class size and limited number of classes provided, all payments for the session are non-refundable. Make-up classes can be arranged solely at the discretion of the instructor and based on availability.

If ThinkAI Academy LLC cancels or reschedules due to insufficient enrollment, instructor availability, or force majeure, a full refund will be issued or a credit applied, at the parent’s election.

No refunds are issued for absences, partial attendance, or early withdrawal after the program has begun, unless ThinkAI Academy LLC initiates the dismissal.
Late Fees & Returned Payments

Balances not received by the due date are subject to a late fee per week until paid, as specified in your enrollment confirmation.

Returned checks or failed ACH payments incur a $35 processing fee.
-
ThinkAI Academy LLC reserves the right to suspend or cancel enrollment for unpaid balances.
Contract - Terms of Business Between Parent & ThinkAI Academy
Legally binding contract between you and ThinkAI Academy LLC
This Agreement is entered into by and between ThinkAI Academy LLC, a California limited liability company (“ThinkAI Academy”), and the parent or guardian identified as the Primary Account Holder (“Parent”), on behalf of the enrolled student (“Student”). By signing this form, Parent agrees to the following terms.
Services to Be Provided

ThinkAI Academy agrees to provide the educational program(s) selected in Section 2 above, subject to the availability of sufficient enrollment and qualified instructors.

ThinkAI Academy reserves the right to modify program content, schedule, or format in the interest of educational quality, safety, or operational requirements, with reasonable advance notice to enrolled families.

ThinkAI Academy will use reasonable efforts to maintain advertised instructor-to-student ratios but cannot guarantee specific instructor assignments.
Parent Obligations

Parent agrees to provide accurate, complete, and current information in this form and to promptly notify ThinkAI Academy of any changes.

Parent agrees to pay all program fees and applicable charges in accordance with Section 12 above.

Parent agrees to ensure the Student adheres to all program policies and the Code of Conduct in Section 8.

Parent agrees to arrange timely drop-off and pick-up, and to designate authorized pick-up individuals in Section 4 of the main checkout form.
Relationship of the Parties

ThinkAI Academy is an independent educational service provider. This Agreement does not create an employer-employee, partnership, or joint-venture relationship between the parties.

Instructors and staff are employees or independent contractors of ThinkAI Academy LLC and are not employees of Parent.
Intellectual Property

All curricula, instructional materials, software configurations, and program content provided by ThinkAI Academy are the proprietary intellectual property of ThinkAI Academy LLC.

Student work product created during sessions remains the property of the Student. ThinkAI Academy may retain copies for internal educational review and portfolio sharing with Parent as described in Section 6.

Parent agrees not to disclose proprietary curriculum, instructional materials, or business processes of ThinkAI Academy to third parties.
Limitation of Liability

To the maximum extent permitted by applicable law, ThinkAI Academy’s total liability to Parent for any claims arising from or related to this Agreement shall not exceed the total fees paid by Parent for the specific session(s) to which the claim relates.

ThinkAI Academy shall not be liable for indirect, incidental, special, consequential, or punitive damages of any kind.
Entire Agreement & Amendments

This Agreement, including all incorporated policies referenced herein, constitutes the entire agreement between the parties and supersedes all prior communications or understandings.

Amendments to this Agreement must be in writing and signed by an authorized representative of ThinkAI Academy LLC.
